Terms and Conditions of the Club de la Montre Extended Warranty
Warranty. The extended warranty is provided by MGH, Manufacture Générale Horlogère, a limited liability company with capital of 301,200 euros, registered with the Auch Trade and Companies Register under number 443 768 452, with its headquarters at Avenue de la Gare, 32700 Lectoure, France, which operates the website clubdelamontre.com. Phone: 05 62 68 55 43, [email protected].
Purpose. The extended warranty extends the manufacturer's commercial warranty on the watch to which it applies by two years. It is purchased at the time of the watch's purchase on clubdelamontre.com and cannot be purchased separately or retroactively.
Price. The price of the extension depends on the price paid for the watch, including any promotions: €19 (including tax) for a watch costing less than €150, €29 (including tax) for a watch costing between €150 and €300, and €39 (including tax) for a watch costing more than €300. It is paid at the time of order and appears on the invoice.
Term. The extension takes effect upon expiration of the manufacturer’s warranty and ends four years after the watch’s purchase date, as evidenced by the order date. It terminates early if the watch is replaced or if a credit is issued under the terms set forth below.
What is covered. Any failure of the watch’s movement or mechanism that occurs under normal conditions of use: quartz movement, electronic module, mechanical or automatic movement, display, and movement functions (date, chronograph, alarm, and alarm clock). Repairs are performed by the warranty provider’s workshop in Lectoure, with parts and labor included.
What is not covered: The battery and its replacement; the strap; the clasp; the crystal; the case and its finish; water resistance and its seals; normal wear and tear; scratches; oxidation; damage resulting from use not in accordance with the instructions (immersion beyond the specified water resistance rating, impacts, exposure to magnetic fields), any work performed by a third party, and watches whose serial number has been removed or altered. The extended warranty is not an insurance policy: it covers only the operational failures described above.
Process. The beneficiary contacts Club de la Montre’s customer service department via the repair form on the website or by email, providing the order number and the email address used at the time of purchase. A shipping label will be provided; shipping costs to and from the workshop are covered by the warranty provider for repairs covered under the warranty. The repair timeframe will be communicated upon receipt of the watch.
Watch cannot be repaired. If the watch cannot be repaired, or if the necessary part is no longer available, the warranty provider will replace the watch with an identical model; if that is not possible, with an equivalent model of equal or greater value; or, if neither is possible, issue a credit for the price paid for the watch, valid for one year on clubdelamontre.com. The warranty extension ends upon replacement or issuance of the credit.
Transfer. The warranty extension is attached to the watch. It applies to anyone who presents the watch along with the order number and the purchaser's email address, particularly when the watch was given as a gift.
Eligible watches. All new watches sold on clubdelamontre.com. Gift cards, watchbands sold separately, jewelry, alarm clocks, and wall clocks are not eligible, nor are brands for which the workshop cannot obtain replacement parts; in such cases, the option is not offered at the time of purchase.
Territory. This offer applies to watches shipped to mainland France, Corsica, and Monaco.
Right of Withdrawal. The extension may be canceled within fourteen days of the order, and in any case as long as the watch is returned under the right of withdrawal; its price will then be refunded along with the price of the watch.
Statutory Warranties. Regardless of this extension, the guarantor remains bound by the statutory warranty of conformity and the warranty against hidden defects.
The consumer has two years from the date of delivery of the goods to enforce the statutory warranty of conformity if a lack of conformity arises. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it first appeared. The statutory warranty of conformity imposes an obligation on the seller or supplier, where applicable, to provide any updates necessary to maintain the conformity of the goods. The statutory warranty of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, at no cost and without significant inconvenience to them. If the goods are repaired under the statutory warranty of conformity, the consumer is entitled to a six-month extension of the original warranty period. If the consumer requests repair of the good but the seller insists on replacement, the statutory warranty of conformity is renewed for a period of two years from the date of replacement of the good. The consumer may obtain a reduction in the purchase price while retaining the good or terminate the contract by receiving a full refund upon return of the good, if the seller refuses to repair or replace the good, if the repair or replacement of the goods occurs after a period of thirty days, if the repair or replacement of the goods causes significant inconvenience to the consumer, or if the lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity. The consumer is also entitled to a price reduction or to rescind the contract when the lack of conformity is so serious that it justifies an immediate price reduction or rescission of the contract. In such cases, the consumer is not required to first request repair or replacement of the goods. The consumer is not entitled to rescind the sale if the lack of conformity is minor. Any period during which the goods are out of service for repair or replacement suspends the warranty period remaining until the goods are returned in working order. The rights mentioned above arise from the application of Articles L. 217-1 through L. 217-32 of the Consumer Code. A seller who, in bad faith, obstructs the enforcement of the statutory warranty of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of the average annual revenue (Article L. 241-5 of the Consumer Code).
The consumer is also covered by the statutory warranty against hidden defects, pursuant to Articles 1641 through 1649 of the Civil Code, for a period of two years from the date the defect is discovered. This warranty entitles the consumer to a price reduction if the item is retained, or to a full refund upon return of the item.
Complaints. Club de la Montre Customer Service, Avenue de la Gare, 32700 Lectoure, [email protected], 05 62 68 55 43. In the event of an unresolved dispute, the consumer may contact the consumer ombudsman, whose contact information is provided in the general terms and conditions of sale.
